General Terms and Conditions (GTC)

The following general terms and conditions (GTC) apply to all products and services offered by Mission 21 on its website. By using our products and services, you accept the following terms and conditions unchanged and in full:

1.1 The subject of these GTC is the use of the products and services that Mission 21 makes available to customers (hereinafter "Customer") on its website.

1.2 When using individual services and products, the customer may be asked to repeat his agreement to the GTC by activating a corresponding input field on the corresponding offer pages.

2.1 Mission 21 provides both free and paid products and services. The current range of services is described on the Mission 21 website.

2.2 The terms and conditions published on the website apply to all products and services. The customer selects the services to be provided by Mission 21 from the range of services available at the time of use.

3.1 Mission 21 operates an online store on its website for free and paid products. The products shown and described in the online store do not constitute a binding offer.

3.2 To order products, the customer makes his selection in the online store. The selection made is displayed in the shopping cart. The customer completes the order of the displayed products by submitting the order form. Mission 21 confirms receipt of the order to the customer by means of an automatic order confirmation by e-mail.

3.3 The order is the customer's binding offer to purchase the products displayed in the shopping cart. The handover of the products for shipment or the handover to the customer at the Mission 21 office is the acceptance of the offer by Mission 21.

3.4 As a rule, the goods are shipped only within Switzerland.

4.1 Delivery shall be made within Switzerland or abroad and in principle by B Mail.

4.2 By selecting the appropriate option in the online store, the customer has the option of collecting the ordered products in person from the Mission 21 office in Basel.

4.3 In the case of products subject to a charge, Mission 21 remains the owner of the products delivered until payment has been received. Mission 21 has the express right to make a corresponding entry in the retention of title register.

5.1 The current price quotations of Mission 21 are authoritative. Prices are generally deemed to be owed in Swiss francs, plus effective shipping costs (postage and packaging).

5.2 There are no shipping costs for pick-up at the Mission 21 office in Basel and for delivery of free products to an address in Switzerland. For delivery abroad, the effective shipping costs (postage and packaging) will be charged for chargeable and free products.

6.1 Mission 21 generally invoices for its services. Invoices are payable within 30 days of receipt.

7.1 The customer has the right to return the products to Mission 21 at its own expense within 14 days of the date of the delivery or invoice bill. Only products that are in perfect condition and are returned complete, with the original labeling and packaging will be taken back.

7.2 Mission 21 will confirm receipt of the returned products to the customer within 10 days of receipt and cancel the invoice. If the customer has already paid the amount, Mission 21 will refund it. At the customer's request, the amount can also be converted into a donation to Mission 21.

8.1 Mission 21 shall perform its services carefully and professionally.

8.2 Mission 21 always endeavors to depict products and services as well as possible and to provide the customer with sufficient information. Nevertheless, Mission 21 cannot guarantee and does not warrant that the images and descriptions of products, the indication of prices and other information available through the Website are accurate, complete and up-to-date.

8.3 The customer is obliged to inspect products delivered by Mission 21 immediately upon receipt. If a product is defective and the defect has not been caused by the customer's negligence, the customer has the right to return the product within 14 days of the date of the delivery bill in accordance with section 7.

8.4 Mission 21 provides a warranty for hidden defects that can be proven to have their origin in defective material or production errors: for in-house productions for 3 months from the date of the delivery bill, for third-party productions for the respective manufacturer's warranty period. The existence of a warranty case is decided by Mission 21 in the case of in-house productions and by the respective manufacturer in the case of third-party productions.

9.1 Mission 21 is only liable for unlawful intent and gross negligence. Liability for slight negligence as well as indirect or consequential damages is expressly excluded.

9.2 Furthermore, any liability for damages caused by force majeure is excluded. Force majeure includes in particular sovereign orders and coercive measures, unforeseeable system failures, interruptions of communication networks, riots and other reasons for a temporary impossibility of service provision by Mission 21, such as flu epidemics.

10.1 Mission 21 ensures data protection and data security within its sphere of influence. Mission 21 handles all personal data with care. Mission 21 takes appropriate organizational and technical measures to protect against unauthorized processing of the data and uses this data exclusively for the purpose of providing its services to the customer.

10.2 Subject to official or court orders, Mission 21 does not pass on data to third parties. Mission 21 retains data only to the extent and for as long as Mission 21 is required to do so by law.

11.1 Should one or more provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. The void provision shall be replaced by a provision that comes as close as possible to the economic purpose of the void provision.

11.2 Mission 21 reserves the right to amend these GTC at any time. Amendments will be made available on the Mission 21 website and will come into force 30 days after they are posted.

11.3 These GTC and any disputes arising from or in connection with the contractual relationship between Mission 21 and the customer are governed exclusively by Swiss substantive law. The exclusive place of jurisdiction is the ordinary courts of Basel. Alternatively, Mission 21 is entitled to take legal action against the customer at the customer's domicile.
